A House in Multiple Occupation (HMO) is a property rented by 3 or more people from 2 or more households who share facilities. Mandatory licensing applies to HMOs with 5+ occupants from 2+ households. Operating without a licence under s.72 Housing Act 2004 can result in penalties up to £40,000.
Penalties vary by offence: unlicensed HMO (up to £40,000), unlawful eviction or harassment (up to £40,000), failure to comply with an Improvement Notice (up to £40,000), Rent Repayment Orders (up to 2 years' rent), breach of banning order (criminal prosecution — unlimited fine or imprisonment), and HMO management regulation breaches (up to £40,000).
